What is an Impact Fee?

    Development impact fees are one-time payments required for new development to fund capital infrastructure needed to serve growth. These fees are not taxes and may only be used for long-term capital improvements.

    Impact fees may only be used for:

    • Police facilities and vehicles
    • Parks and recreation improvements
    • Multimodal transportation improvements

    Impact fees may not be used for operations, maintenance, replacement of existing infrastructure, or correcting existing deficiencies. (C.R.S. § 29-20-104.5)

    When Do Impact Fees Apply?

    Impact fees apply to:

    • New construction (residential and nonresidential)
    • Additions to existing nonresidential development
    • An increased number of dwelling units
    • Change of use to a more intensive development type
    • Redevelopment

    Fees must be paid prior to building permit issuance. No certificate of occupancy will be issued until all required impact fees are paid.
